The Affordable Care Act is expanding the definition of the “small employer group” to include 1 to 100 employees for plan years beginning on January 1, 2016. (This is a change from 1 to 50 employees.)

As a result, groups with an Average Total Number of Employees (ATNE) of 1-100 will be subject to adjusted community rating unless your plan is grandfathered or qualifies for another exception. Many carriers will be sending surveys to collect information on the number of your eligible employees so they can correctly determine your group size.
